Capital Punishment         First of all, capital punishment is constitutional. The eighth Amendment of the Constitution prohibits the use of merciless and unusual punishments; however, the death punishment does not fall under those prohibited punishments. According to evaluator Antonin Scalia in a concurring opinion of Callins v. It is clear that the majority of U.S. Supreme Court, the highest court in the United States, agrees that the death penalty is not a cruel and unusual punishment. on that pointfore, the death penalty is perfectly legal in the eyes of the Constitution.
        Secondly, capital punishment does not lead to miscarriages of justice. There is no proof that definitely shows that unimpeachable people argon being killed by the installment of capital punishment.
